Mike Tremeer, Partner at Fladgate, takes to the stand to update delegates on the main employment law cases that impact payroll from the past year.

IR35 grabbed headlines this year in the case of former BBC presenter Christa Ackroyd. It was found that she should have been applying IR35 because, if it hadn’t had been for her company, she would have been considered as an employee.

The government recently launched a consultation into off-payroll working in the private sector – highlighting that this is a big issue for employers.

There have also been two interesting cases relating to shared parental leave (SPL). In Ali v Capita it was found that failure to pay enhancing SPL is not direct sex discrimination. However, in Hextall v Leicestershire Police the door is potentially the door may still be open for indirect sex discrimination.
